1. Commitment to Intellectual Property Rights

Clothguy acknowledges the importance of protecting creative and brand assets. All material on our website—including but not limited to product images, descriptions, designs, trademarks, logos, and written content—are either owned by Clothguy or lawfully licensed from third parties. These elements are safeguarded under applicable intellectual property laws.

Use of this website does not grant users any rights to such content. Unauthorized copying, distribution, or commercial exploitation of these materials is strictly forbidden.


2. Prohibition of Infringing Material

Our platform prohibits the listing, posting, or sale of any item or content that infringes on a third party’s copyright, trademark, or other intellectual property rights. Whether intentional or inadvertent, such activity undermines the integrity of our business and violates our Terms of Use.

Clothguy reserves the right to remove any content or products that we reasonably believe infringe upon protected IP rights.


3. Submitting an Infringement Notice (DMCA Procedure)

Your notice must include:

  1. Identification of the copyrighted work or trademark that is being infringed.
  2. URL(s) or listing name(s) on our website that are allegedly infringing.
  3. Your full name, address, telephone number, and email address.
  4. A statement asserting a good-faith belief that the use in question is unauthorized.
  5. A statement made under penalty of perjury that the information provided is accurate and that you are the owner or authorized to act on behalf of the owner.
  6. Your physical or electronic signature.

This reporting protocol is established in accordance with the Digital Millennium Copyright Act (DMCA).


4. Response and Investigation

Upon receiving a valid IP claim, Clothguy will take the following actions:

  • Review and investigate the claim in a timely manner.
  • Remove or restrict access to the material if the claim is deemed valid.
  • Optionally notify the party responsible for the content.
  • Where appropriate, allow that party to submit a counter-notice under the DMCA if they believe the removal was mistaken.

5. Policy on Repeat Offenders

Clothguy maintains the right to suspend or terminate any user, seller, or account that repeatedly infringes upon intellectual property rights. The decision to terminate will be made at our sole discretion, based on frequency and severity of violations.


6. Consequences for Misuse

Knowingly filing false infringement reports is a serious offense. Submitting fraudulent or bad-faith notices may subject the sender to liability for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f).
